2nd DUI within 5-Years Reduced to Reckless Driving

Facts:
My client was stopped for speeding in Hillsborough County. Upon initial contact, the Officer claimed he saw indicators of impairment. After my client performed field sobriety exercises, the Officer requested he submit to a breath test and my client refused. My client was then charged with DUI and a Refusal.

Since my client had a prior DUI in 2019, he found himself facing a mandatory 10-day jail sentence, a five year driver’s license revocation, and 1-year ignition interlock.

The Case:
Upon a careful review of the evidence, I realized the Officer didn’t have sufficient indicators of impairment to request that my client submit to field sobriety exercises. I also identified inconsistencies in the police report related to how my client performed on those exercises and how he refused the breathalyzer. I worked diligently to build a strong defense highlighting these discrepancies and challenging the validity of the DUI investigation.

The Result:
We presented a strong argument to the State Attorney and they agreed to amend the DUI to a Reckless Driving. This outcome was a significant victory, as my client was facing time beyond the mandatory 10-day jail sentence, a 5-year driver’s license revocation, and 1-year ignition interlock. I am proud to have helped our client avoid these severe penalties and move forward with his life in a positive direction.
