Facts:
My client was involved in a crash in St. Petersburg where she lost control of her car and hit a water line. She was investigated for DUI by the St. Petersburg Police Department and blew a .18. She had just had a DUI a year before and did not have a driver’s license. It was her third DUI overall. She was arrested for felony DUI and felony driving on a suspended license and taken to the Pinellas County Jail. She bonded out and was given a CAM monitor to detect alcohol.
Her brother is a client of mine and asked me to get her help.
The Case:
I knew immediately that there was no defense to this case and that my client needed help. I knew that the state and the judge would be looking for a lot of jail if she didn’t fix her issues. She had a history of mental health problems and knew that she needed help. Our team worked to get her into a rehab program that she could afford. She went for 30 days of inpatient and then followed up with an intensive outpatient program. She went to classes for 3 hours a day and the program lasted for 12 weeks. I also advised her to keep the ankle monitor on because it proved that she was not drinking.
The Result:
I was able to get a deal where all of the jail was substituted for the 30 days of inpatient rehab that she did. So, she did not have to go to jail. She was placed on probation and ordered to continue with her counseling. The only extra penalty that was added was that she had to keep the ankle monitor on for another 6 months. It was an unbelievable result and was only possible because she went out and got the help that she needed. These types of results only happen when my clients are proactive and help themselves.
