Facts:
My client was on his way to Wawa. He goes every day to pick up coffee. As he was pulling in, a woman in another car thought he cut her off and gave him the finger. They both wound up pulling into the Wawa parking lot. While they were inside, the woman was animated and started complaining to the Wawa staff about him. As she left, my client tried to get her attention and reached out to stop her. He touched her shoulder and she freaked out. The police were called and charged him with misdemeanor battery for the unwanted touching.
The Case:
I knew that the victim in the case was going to be a problem. But, my client had never been in trouble before and the battery was quite minor. It was clear that he didn’t have any intent to commit a crime. I put together a lengthy letter explaining the situation and asking for it to be dismissed.
The Result:
The prosecutor agreed that the charge should be dismissed, but the victim wanted blood. So, the prosecutor could not drop the case without some penalty. We agreed that my client would write a letter of apology and do 25 hours of community service. Once that was completed, the charge was dropped and his record stayed clean. He is now eligible to expunge the history of this charge as well.
