Facts:
My client was driving home on his motorcycle late at night after leaving downtown St. Petersburg. He had been drinking and was rushing to get home. On the way, he tried to cut through traffic, clipped a car, and lost control. He crashed and seriously injured his arm. He was taken to Bayfront where he underwent surgery.
The Florida Highway Patrol arrived at the hospital and did not conduct a DUI investigation. Instead, they issued him a citation for misdemeanor reckless driving.
The Case:
His mother hired me to help as he had never been in trouble before and wanted to keep his record clean. I had him sign up for ADI school immediately. Once that was done, I sent it to the prosecutor and asked for the charge to be amended.
The Result:
The prosecutor agreed to amend the charge to careless driving at his first court date. My client did not have to go to court. Careless driving is a civil citation and he did not get points. All he had to do was to pay a $166 fine. He realized that he got very lucky with this result and I spoke to him at length about making sure he was making better decisions in the future.
