Second Charge for Domestic Violence Dropped in a Year

Facts:
I previously represented this client for a similar domestic battery charge in 2023 and had it dropped. The incident involved her husband and they had stayed together. I was surprised to get the call that there had been another incident, especially since it had been less than a year.

In this incident, the situation was very similar. Alcohol was involved and it got physical. Her husband called the police and the Pinellas County Sheriff’s Office responded. Because the husband had scratch marks and broken glasses, my client was arrested and charged with a domestic battery. Her husband appeared at the advisory hearing and said that he would move out so that she could return to the home. As part of her release, she was ordered to have the CAM monitor on her ankle to detect alcohol.

The Case:
I knew that a second domestic in such a short period of time was going to be hard to get dropped. But, the husband was adamant that he did not want her charged. This time, he wanted a divorce and to move on with their lives.

The Result:
My client got very lucky because the state dropped the charge. The husband also hired a lawyer for the divorce who got involved to push the prosecutor for a dismissal. My client was very happy to be done with the case. We are all hoping that they can move on with their lives with no further incidents.
