Our client found themselves facing a mandatory 10 day jail sentence and a five year driver’s license revocation after being arrested for DUI and reckless driving. The circumstances were particularly challenging: an early morning arrest for allegedly driving 120 mph, with the officer claiming to smell alcohol. Our client did not perform field sobriety tests and refused the breath sample.
Recognizing the gravity of the situation, we immediately began a thorough review of the case. We identified inconsistencies in the police report and noted mistakes made during the investigation. We worked diligently to build a strong defense, highlighting these discrepancies and challenging the validity of the arrest.
Simultaneously, we took proactive steps with our client. We recommended and facilitated the completion of the Advanced Driver Improvement (ADI) course, demonstrating our client’s commitment to taking responsibility and addressing any potential issues.
Our persistent efforts and strategic approach paid off. We presented a compelling case to the State Attorney, emphasizing the weaknesses in the prosecution’s evidence and our client’s proactive steps. We are pleased to report that the State Attorney agreed to drop the DUI charge.
Our client ultimately resolved the case with 25 hours of community service, attendance at a MADD Victim Impact Panel, the previously mentioned ADI school, and 3 months of probation for the reckless driving charge. This outcome was a significant victory, as our client was initially facing a mandatory 10-day jail sentence and a 5-year driver’s license revocation due to the second DUI arrest. We are proud to have helped our client avoid severe penalties and move forward with their life.
