Facts:
My client stopped by a restaurant on Treasure Island to pick up some food after a long day of working on her house. She was ordering take-out and decided to have a drink while she waited for the order. She did not drink much, but either there was something in her drink or some reaction to medication that made her act impaired. She was asked to leave and when she refused, the Treasure Island Police Department was called. They arrested her for misdemeanor trespass and took her to the Pinellas County Jail.
The Case:
Fortunately, her husband had gone to pay the bill the next day and talked to the manager. The restaurant did not want to press charges, which I knew would help. I wrote a lengthy letter explaining the situation and asked the prosecutor to dismiss the case.
The Result:
After about a month from the time of the arrest, the prosecutor agreed to drop the case. My client never had to go to court and now she can expunge her record. It was a good result for a night that went quite wrong.
