Facts:
My client was coming home to his apartment complex late at night. His apartment building had an indoor garage. As he pulled into a parking space, he hit the car next to him. Because he might have been drinking, he went upstairs and went to bed.
The following morning, the owner of the damaged car called the police. It was pretty obvious to see what cars had been involved. My client was issued a criminal citation for leaving the scene of an accident, a misdemeanor.
The Case:
My client had no prior record and a good job. I had him complete ADI school and report the accident to his insurance company. I then wrote a letter to the prosecutor explaining his background and the steps that he had taken to fix the issue. I asked for an amendment of the charge.
The Result:
The State agreed to amend the charge to a civil charge called failure to report. He did not get any points on his license and only had to pay a $116 fine. My client was thrilled with the result. He will not have a crime on his record either.
