Facts:
My client and his girlfriend came to town for a motorcycle event and concert at OCC Roadhouse on 49th St. in Pinellas Park. They were drinking and having a good time. During the concert, the girlfriend began dancing with other men, which angered my client. The situation escalated and after he tried to pull her away, he allegedly slapped her.
There were many witnesses and they called the police. My client was arrested for misdemeanor domestic battery and taken to the Pinellas County Jail. He saw a judge the following morning and his girlfriend attended and asked for contact and for the case to be dropped. The judge did not care and ordered no contact and he was given a GPS ankle monitor.
He hired me immediately and we got to work.
The Case:
I immediately had my client sign up and start attending the batterer’s intervention program (BIP). I also called his girlfriend and prepared her for what to expect from the case. I also had her sign a request not to prosecute.
The Result:
After a couple of weeks, the prosecutor called the victim/girlfriend and discussed the case. I followed up with a call to explain the circumstances. Fortunately, the case was dismissed in less than three weeks from the date of the incident. My client was able to immediately get the GPS monitor removed and have contact with his girlfriend.
