Domestic Violence Charge To Be Dropped After Counseling

Facts:
My client, his wife, son, and in-laws were in Clearwater Beach for Mother’s Day. My client was not drinking, but his wife and her stepfather both had too much. As they were leaving the parking lot, an argument started. The stepfather grabbed her and pulled her back into the car. It was alleged that my client also grabbed her.

Three bystanders called the police and Clearwater PD responded. My client denied that he ever touched his wife and said that he never got out of the car. The police arrested him for domestic violence anyway.

The Case:
The wife and family were adamant that my client never touched her, but the 911 calls from the witnesses described my client as being involved. I asked for the case to be dismissed, but the prosecutor wanted to make sure this incident did not happen again.

The Result:
The prosecutor and I made a deal where my client would not get charged if he completed the 29-week anger management program. The case will basically be in suspense until he completes the program and then it will be dismissed. We were able to go into court and allow contact with his wife during this time. Getting a guaranteed dismissal was a good result to protect his record and avoid the risk of trial.
