Facts:
My client, a 16-year-old, brought his father’s firearm to school in his backpack. Although there was no intention to use the weapon, he did show it to other students. When approached by law enforcement, my client acknowledged possessing the firearm and fully cooperated.

The Case:
My client was charged with Possession of a Weapon on School Property, a third-degree felony. Despite having no prior record, excelling academically, and causing no harm, the severity of the offense and the involvement of a firearm led the Department of Juvenile Justice to recommend commitment. Upon receiving this recommendation, I advised my client to promptly enroll in counseling.

The Result:
After my client completed certain mitigation, we scheduled a disposition hearing to present our argument to the Judge and request a departure from the Department’s recommendation of commitment. At the hearing, the Judge withheld adjudication and sentenced my client to probation. The family was relieved, knowing their son would avoid time in the Juvenile Detention Center and the extended stay in a commitment program that would have followed.
