Habitual Traffic Offender Designation Avoided After Four DWLSR’S

Facts:
My client was charged with four Driving While License Suspended/Revoked (DWLSR) all within a 1-year period. Not only that, but he picked up new DWLSR’s while out on bond for DWLSR and then failed to appear in court for those charges. As a result, his bond was revoked.

The Case:
If  convicted of three DWLSR within 5-years you are deemed a habitual traffic offender (HTO), face a mandatory sentence of 10-days in jail, and a 5-year drivers license suspension. Due to my client’s actions while out on bond, the Judge would not reinstate his bond. The goal was to avoid the HTO designation, otherwise, my client would lose his license, then his job, and then his housing.

The Result:
I was able to clear up my client’s holds on his license while he was in custody. After the holds were cleared, I was able to convince the State to amend two of the DWLSR charges to a No Valid Driver’s License.
As a result of those amendments, my client avoided the HTO designation. This was a great result and allowed my client to move forward in a positive direction without all the harsh penalties of an HTO designation.
