Domestic Violence Injunction Dismissed After Trial

Alec Waid’s client was facing a domestic violence injunction by her ex-boyfriend who was attempting to use an injunction to gain an advantage in a child custody dispute. The injunction for petition was based on meritless claims. In fact, the petitioner had been convicted multiple times of domestic violence against Alec’s client.

When the injunction was filed, Alec immediately got to work. He pulled the petitioner’s criminal record and obtained police reports from the petitioner’s arrest. He also took the petitioner’s deposition where he was able to dissect the petitioner’s claims, pointing out the inconsistencies and even got him to admit he had lied to a court in the past in order to gain advantages in child custody disputes with other women. Despite this work, the petitioner still refused to drop the petition for injunction against Alec’s client.

Ultimately, instead of agreeing to continue the injunction, Alec and his client took the case to trial. After cross examining the petitioner and a law enforcement officer at trial, Alec convinced the Judge to dismiss the injunction against his client. Alec’s client avoided a final injunction going on her record and was able to be with her one-year-old child again. This case is a testament to the value of hiring a lawyer who is not afraid to go to trial–no matter the severity of the allegations against you.
