Facts:
My client and his sister have a very bad relationship. They hadn’t talked in a year. A family issue set my client off and he began to text his sister repeatedly. She hired a lawyer to send him a cease and desist. He didn’t listen and kept texting her, so she filed a stalking injunction against him. The temporary injunction was granted and a hearing was set.
He had a good job and was a coach for his child’s soccer team, so having an order finding that he had committed stalking was not something that he wanted on his record. He hired me to help.
The Case:
The case was not great. He had sent a lot of texts and they did not look good. His sister also hired a lawyer to handle the stalking injunction. She was very mad, but I tried to reason with her. The judge also implied that her best case scenario if she won the hearing would be a 6 month injunction. I offered that my client would agree to extend the temporary injunction for 12 months if she would agree to it. I explained that if the injunction was granted, it would hurt his career and his child.
The Result:
Ultimately, my client’s sister did not want his career or her nephew affected by this injunction. She agreed to extend the temporary injunction for 12 months to keep his record clean. It was a good compromise that benefited both parties.
