The Arrest

Our client was arrested for DUI in Largo, FL he was stopped by law enforcement for driving 75 mph in a 45 mph zone. Largo Police officers smelled the odor of alcohol and our client was swaying and had bloodshot eyes. Law enforcement conducted a DUI investigation and our client performed poorly on field sobriety tests. After he was arrested for DUI, he provided a breath sample of .154% Breath Alcohol Content (BAC).

 

The Criminal Case

After our client was arrested for DUI, he contacted our office right away. He is a healthcare worker and a DUI conviction may have negative implications. He is also green card holder from Africa and is in the process of applying for US Citizenship. While not necessarily a bar to citizenship, a DUI is considered as a part of the process. After he came in, we got to work on getting his charge reduced from a DUI. We had our client complete DUI school, a Victim Impact Panel, and community service through a local provider.

 

The Plea Deal

Because his BAC was over .15, he did not qualify for the D.R.O.P. program. However, because of game plan early in his case, we were able to use our client’s actions to persuade the State Attorney’s Office that a Reckless Driving disposition was appropriate. This outcome will be life changing for our client as his career and his citizenship were potentially on the line.
