Facts:
My client and his girlfriend were going through a breakup. They had a bad fight two weeks earlier but later reconciled. On the evening of the incident, an argument about infidelity escalated out of control. My client called his mother to come help.
When his mother arrived, the situation turned physical and chaotic. She called the police for assistance. Once the police arrived, my client was arrested for misdemeanor domestic battery. He was also charged with felony criminal mischief for breaking his girlfriend’s phone. However, the girlfriend was also arrested and charged with misdemeanor battery for attacking my client’s mother. It was a real mess of a situation.
The Case:
I got up to speed quickly and ordered the 911 call. Fortunately, the girlfriend hired another lawyer whom I knew. I called him and offered a deal: my client would pay for the broken phone, and my client’s mother would drop the battery case if the girlfriend agreed to drop the charges against my client.
The Result:
The other lawyer agreed, and we had each of the women sign a request not to prosecute. We sent the requests to the prosecutor and informed him that we had resolved our differences. He agreed to drop all charges against both women. My client was never formally charged and never had to go to court. He is now eligible to have the case expunged from his criminal record.
