Facts:
My client and his wife were arguing over finances. The wife refused to let him see her online banking account and this caused a big issue. It got physical as he tried to see the computer and she refused. It was alleged that he pulled her to the ground and punched and kicked her. The children were also present and observed it. The wife called the police and the husband was arrested for domestic battery. He was taken to the Pinellas County jail and released.
He could not go home because of a no contact order, but a neighbor helped bring the children to him so that he could visit them.
The Case:
I knew that this was going to be a tough case. There didn’t seem like much of a defense. But, this was his first arrest, so I knew there was a chance. I had my client enroll in the Batterer’s Intervention Program (anger management classes).
I reached out to his wife who said that she did not wish to prosecute. I told her what to expect with the case and had her sign a request not to prosecute.
I then wrote a detailed letter to the prosecutor with all of the information.
The Result:
The prosecutor agreed to dismiss the case after she spoke to the wife. My client was very happy and can now go home, see his children regularly, and work on his marriage. He also is eligible to expunge his record.
