Facts:
My client was riding a motorcycle in St. Petersburg when he was stopped for not having it registered. During the stop, the officer also learned that he did not have a valid motorcycle endorsement. She then searched his bookbag and found a jar containing THC wax and other paraphernalia. He was arrested and charged with a felony and two misdemeanors. He was released from the Pinellas County jail and contacted me.
The Case:
My client had never been in trouble before, but I knew that he needed to get into treatment. I had him get a substance abuse evaluation and he began counseling. In the meantime, he got the motorcycle registered and got his motorcycle endorsement.
I submitted everything to the prosecutor. My main defense was why the office searched his bookbag when all he had done was operate a motorcycle without the proper paperwork. I asked for the THC wax and paraphernalia charge to be dismissed and for any other charges to be civil infractions.
The Result:
The prosecutor agreed. The felony THC wax charge was dismissed. The misdemeanor paraphernalia charge was dismissed. And, the no valid motorcycle endorsement misdemeanor was amended to a civil infraction.
My client only had to pay a fine of $116. There are no criminal charges on his record and not even any points on his license. He is also eligible to expunge the history of the arrest.
