Facts:
My client and his girlfriend were at Postcard Inn on St. Pete Beach. While they were there, they ran into a woman who claimed that his girlfriend owed her money. After she came up multiple times asking for money, my client pushed her away. There was a lip behind her and she fell off the deck and was injured. My client was arrested for felony battery.
The Case:
The case was challenging because the victim was very upset. The State wanted my client to go to jail for 90 days. He had a bad prior record too, so that made it challenging.
The Result:
I was unable to get a deal done with the prosecutor, so I asked the judge to give him probation. I had my client pay the restitution in advance and do anger management. The judge agreed to give him probation, but also ordered him to get an alcohol evaluation to make sure that he did not have a drinking problem. It was a good result on a case that could have gotten out of control because the victim was so angry.
