Facts:
My client was a dancer at a gentlemen’s club. One night, detectives from the Pinellas County Sheriff’s Office showed up undercover. They asked her if she knew how to get cocaine. She agreed, took $60 from them, and returned with .6 grams of cocaine. She was arrested and charged with felony sale of cocaine and felony possession of cocaine.
The Case:
She had never been in trouble before and learned her lesson. She quit her job at the club. I knew that the prosecutor would want to know if she was a drug user/abuser too. I had her get a substance abuse evaluation. I knew there was no defense to the case, so it was all about minimizing the consequences.
My client was concerned about going back to jail and avoiding felony convictions on her record. We submitted a lengthy explanation of what happened and what she had done after the arrest to make sure that this never happened again.
The Result:
The prosecutor agreed to give her another chance. We were able to arrange a plea deal where she received a withhold of adjudication on both charges so she did not have any felony convictions. Also, instead of jail, she got 18 months of probation and can get off after 9 months. It was a good result because the penalties could have been much worse.
